Definitions

I, me: Nicholas Moore, a sole trader in the United Kingdom doing business using the the trading name Pilotmoon Software. For business contact details, see about.

You: a customer who has bought a license for a product.

Product: a software application I have developed and own the rights to. My current products include Dropshelf, DwellClick, PopClip, RapidClick and Scroll Reverser.

App Store: Apple’s Mac App Store.

Reseller: a business with whom I have an arrangement to sell licenses for products (see Appendix A).

Free trials

Products may have a free trial mode which lets you try the software to see if it meets your needs. I encourage you to make use of the free trial before buying.

App Store purchases

App Store purchases are subject to Apple’s standard End User License (EULA).

Products you buy through the App Store are delivered to you by Apple using the App Store’s installation and update mechanism.

Note: Apple’s standard EULA entitles you to install and use the product on any Mac that you own or control. To install your product on a new machine, sign in to the App Store using your Apple ID and find the product in the “Purchased” section of your account.

Reseller purchases

License agreement

In consideration of the purchase fee paid by you to the reseller, I grant you a non-exclusive, non-transferable, non-sublicensable, perpetual, irrevocable (subject to payment of the purchase fee when due and payable, and subject to maintaining the confidentiality of the license key), royalty-free right and license to use the product, subject to these terms and the reseller’s terms.

License keys

You will receive a license key by email as part of the order process. The email will contain instructions on how to activate the product.

You can use the license key to activate the product on more than one machine, with the following restrictions:

The license key is a unique to you and may only be used by you and, for a multi user license, any legitimate additional users. If you share, publish or otherwise allow any use of your license key beyond that granted by the license, your license will be revoked and you may no longer use the product. In such a case, I may use technical means to disable the use the license key.

Updates

I may, at my sole discretion, provide updated versions of the product after purchase. Your entitlement to these updates depends on the type of license:

Note: Whilst it is my intention to keep my products updated, including to provide compatibility with operating system updates, the feasibilty (both technical and commercial) of such updates is subject to unknowable future circumstances. Therefore, I make no guarantee that I will update any product, whether to add features or to correct errors. You should base your purchase decision only on the version of the product that already exists at the time of purchase.

Refund policy

App Store refunds

App Store purchases are subject to Apple’s refund policies. If you want a refund for your purchase from the App Store, please contact Apple support.

Reseller refunds

For reseller purchases, you may request a refund from from me for 30 days from the date of purchase. You do not need to provide a reason. To request a refund, email me at support@pilotmoon.com, stating your purchase order number and the email address you used for the purchase. When I receive your refund request I will ask the reseller to send back the money in full. After you receive the refund, your license is revoked and you may no longer use the product.

Please note that I will usually lose money on any refund due to transaction fees. Therefore, I ask that you make use of the free trial before buying, and only ask for a refund in exceptional circumstances.

I reserve the right to refuse refund requests that appear fraudulent or abusive.

Free software

I may from time to time make some software and add-on extensions available under free software licenses. Your use of such free software and extensions is subject to separate license terms, and is not included in the product license.
